TERMS AND CONDITIONS
The following terms and conditions apply to all orders placed by businesses or private customers (hereinafter referred to as “customer”) at the online shop of Desta Lab GmbH, Werikonweg 5, CH-8006 Zürich (hereinafter referred to as Desta). The terms and conditions apply exclusively and in the existing version at the time of order. The product range is available in Switzerland and abroad and the prices for the supplies and services in this contract are in Swiss Francs, below abbreviated as CHF.
The customer submits a legally binding bid by placing an order and accepting the terms and conditions. The contract between the customer and Desta is not concluded until the order placed by the customer is accepted by Desta. Desta accepts the order by providing the customer with an order confirmation via email. Confirmed orders cannot be cancelled by the customer.
All product descriptions are available only in English at the moment. If you need more information or you would like to have a product description in German, please contact us. We do our best to present and describe the goods as realistically as possible. Nevertheless, slight deviations in colour can occur through presentation on monitor or print.
All published prices are indicative prices that are continuously adjusted to the market. These are in Swiss Francs (CHF), including VAT.
Shipment takes place twice a week. All shipments are dispatched by Swiss Post by means of registered package/tracking number. Within Switzerland shipping by Swiss Post services is included. For shipping abroad Desta uses Swiss Post and DHL Express, extra shipping costs will be charged. In this case please contact us by email on firstname.lastname@example.org. Any additional costs during the import process for customs, clearance and compulsory taxation at the delivery address specified by the customer will be borne by the customer. Desta reserves the right to choose a different delivery method in individual cases.
Shipment will be dispatched after successful payment with Stripe (Master Card, Visa, American Express) or Paypal. Payment is due at the order confirmation by Desta.
7. RETURN AND REFUND POLICY
You have to check the ordered products immediately upon receipt for defects and completeness and notify Desta of any defects within five days of receipt of products by email at email@example.com. Desta will get in touch with you after receipt of notice to find a solution for you. Please return the items in an undamaged, complete original state without traces of usage and in an undamaged original packaging. The right of return begins with the receipt of goods by the customer. The customer bears the costs and any risk and liability for the return shipments. Goods that get lost during shipment will not be refund. We recommend tracked and/or insured shipments.
The returns will be refused if traces of usage exist, if products are sent back without the original packaging and labels, or if goods are damaged. No rights of return on clearance sales (sale). If goods are not available at the producer due to external factors (unstable political conditions, delay or refusal of export at the border, etc), Desta has the right to cancel the order and refund any advance payment money to the customer.
8. DAMAGED GOODS AND INCORRECT DELIVERY
Every good is carefully controlled by Desta before dispatch. Should there be a manufacturing defect that escaped our attention, the goods can be returned.
According to art. 185, par.2 of the Swiss Code of Obligations, the benefit and the risk for the ordered goods are transferred to you once the parcel has been handed over to the delivery provider. Should a damage occur during the transport to you, please document it with photos and immediately contact the delivery provider to let them know about the damage. Please also inform us on firstname.lastname@example.org. In case of incorrect delivery due to error from Desta side, the return fees will be paid by Desta.
Desta is not liable for damages that are cause by incorrect use or natural wear and tear. If reselling the product, the customer is responsible for compliance regarding national and international export provisions. If changes are made to the resold product, the customer is liable for the resulting damages to Desta, the purchaser or third parties.
10. PROTECTION OF INTELLECTUAL PROPERTY
Desta reserves all the rights for any design, text or graphics on Desta.ch website. Reproduction, modification or copying of the contents of the website are prohibited without written permission from Desta.

12. JURISDICTIONS AND APPLICABLE LAW
The present terms and contracts are subject exclusively to Swiss law. Place of jurisdiction is Zürich, Switzerland. For any disputes resulting out of this contract the parties shall try to find an amicable settlement.
13. FINAL REGULATIONS
By ordering goods, the customer agrees to these terms and conditions. Desta reserves the right to modify the terms and conditions at any time.
